Surprise, surprise. No sooner than I have been working on these pages and my Special Report for about
2 weeks, I notice in my Click Logs that every domain name I own is being checked out. Then, last Thursday
night, March 19, 2009, I get a knock on my door, where a Process Server stands to serve me a Summons to
Foreclosure Proceedings in the name of a U.S. Bank - not the bank I had been making my payments to.
Working on software for Word Processing Online and EZ Web Pages for about 7 years, I was unaware
that the banks had fouled everything up - and that whoever was receiving my payments might not
have a right to them). But business was slow, so I suspended making payments on my house for a while.
I was concerned about foreclosure, but had heard Jamie Dimon of JPMorgan (which had taken over
Washington Mutual) say his bank had "a voluntary moratorium on foreclosures". Some reassurance.
So I was surprised to see this Process Server with a Mortgage Foreclosure Summons arrive, but then I read
it was from some other U.S. Bank. (What is going on here?) It turns out that just as April Charney describes,
that U.S. Bank claims it has no Note (to enforce), and alleges that such Note as they want
to enforce actually could have been "lost", "destroyed", or taken into "unlawful possession" of
"unknown persons" before it got to them, i.e., while somewhere else with some predecessor (before them).
To me, that admission that it could have been "lost", "destroyed", or taken into the "unlawful
possession" of some "unknown person" prior to when that U.S. Bank ever got it,
means that as a positive logical matter,
such U.S. Bank must not know it ever received such Note, or any valid title to it,
must not have the required Indicia of ownership, meaning via all the DULY-
AUTHORIZED POWER(S) OF ATONRNEY POSITIVELY REQUIRED by law for a valid assignment of ownership.
I mean, U.S. Bank positively said in its Summons that such Note MIGHT HAVE DISAPPEARED before
U.S. Bank ever got it. FOR THAT TO BE POSSIBLE, U.S. BANK MUST POSITIVELY HAVE NO RECORD OF HAVING SEEN IT.
How can we deal with that?

JULY 11 UPDATE: Since my
Motion to Dismiss of early April, 2009 (pro se: representing myself), as of July 11, 2009,
the other side has done nothing more. They seem to have set it aside, "dormant",
as the resources say they often do when correctly challenged.
Maybe they marked it "Dangerous/Do Not Touch" and stuck it in a corner? I thought they would,
seeing the facts presented in my Motion to Dismiss.
I am not a lawyer (we are allowed to go into Court ourselves, or "pro se", and apparently I did
not need to be a lawyer, using these resources). If my "pro se" Motion to Dismiss could provide some valuable
information for you and/or your attorney, I encourage you to check it out.
